These terms govern the supply of IPComms internet and voice services. By signing up you agree to the terms below.
Lead Times & Installation
Our official lead times are up to six (6) weeks, although most installations happen within two weeks. New areas where fibre is being rolled out may have extended lead times. Our team is always working hard with our suppliers to ensure our customers' installations happen as quickly as possible, but unfortunately, we cannot make any guarantees pertaining to delivery times.
Free Router
We provide a standard free router with our services. This router remains our property for the minimum term of 24 months. After this period, the router becomes your property. Please note that we do not provide warranty or cover for the router, and you will be liable for any replacement costs.
In the event of cancellation of services before the 24-month minimum term has been met, it is the customer's responsibility to return the router to IP Comms. Failure to return the router within 30 days of cancellation will result in the customer being liable for the replacement cost of the router.
Cancellation
The customer must give one clear calendar month's notice of his/her intention to cancel the services by contacting accounts@ipcomms.co.za. Any notice given on or after the first day of the month will only take effect on the last day of the following month. Example: (a) notice received on 30 April, cancellation to be effective 31 May; (b) notice received on 1 May, cancellation will be effective 30 June.
If the cancellation above results in the termination of services prior to 12 months' duration, IP Comms shall be entitled to levy a termination fee of approximately R4 030 incl. VAT.
If the customer terminates an order prior to it being activated by IP Comms, then the customer shall be liable to IP Comms for any installation and other charges that it is liable to pay the fibre network operator.
Migrations carry a minimum 6-month commitment; cancellation before the term expires will result in Migration Activation claw-back fees.
Relocation
Relocating to a new premises will be treated as a cancellation of your current fibre service, as fibre cannot be transferred. Please note a minimum of one clear calendar month's notice is required to terminate your existing fibre connection. Alternatively, you can transfer the service to the new owner's name at the current premises. If you'd like to continue our services at the new location, a new application will be required.
Billing
A deposit may be applicable, subject to the outcome of our credit assessment.
Prices are subject to change. Customers will be notified of any price adjustments before they take effect.
Billing will commence from the date the service is activated by the fibre network operator and made available for use.
Our billing terms are prepaid. Invoices are generated on the 25th of each month for the following month's services.
Please note that the first invoice may include a pro-rata charge for the remaining days of the month from the date of going live, as well as the full monthly service fee for the next month in advance.
Where payment is made by debit order, the customer shall ensure sufficient funds are available. Failed debit orders may attract bank charges, administration fees, and service suspension.
We reserve the right to suspend your service without notice if payment is not received by the due date, or if a debit order is returned unsuccessful.
Services suspended due to non-payment may be subject to a reconnection or reactivation fee before service is restored.
Call-out Fees
In the event of issues with your service, we'll attempt to troubleshoot and resolve the issue remotely whenever possible. If a site visit is required, a standard call-out fee will be applicable. Additional charges may apply if further work or repairs are necessary beyond the standard call-out.
Debt Collection & Legal Costs
Should the customer's account be handed over for collection or legal action due to non-payment, the customer shall be liable for all reasonable collection costs, tracing fees, attorney-and-client legal fees, and related disbursements incurred in recovering outstanding amounts.
Service Availability & Network Outages
IP Comms provides internet access on a best-effort basis. While every reasonable effort will be made to ensure uninterrupted service, IP Comms does not guarantee continuous availability of the service and shall not be liable for interruptions, delays, maintenance, fibre breaks, power failures, network congestion, acts of third parties, or circumstances beyond its reasonable control.
